HiFriends Terms of Service

1. Welcome to HiFriends

These Terms of Service ("Terms") are between you and HiFriends Inc. By using HiFriends, you agree to these Terms and our Privacy Policy.

2. How HiFriends Works

Core Features

• Automatic Delivery: When you take a photo, we use face recognition to automatically deliver it to everyone in the photo
• Your Feed: Receive photos of yourself taken by others
• Cascade Delete: Delete any photo of yourself from everywhere on HiFriends - your feed, photographer's camera roll, and everyone else's feed
• Your Profile: Share selected photos publicly on your profile

3. Your Account

Requirements

• You must be 13 or older
• Provide accurate information
• Keep your password secure
• One account per person - Creating multiple accounts is prohibited

By creating an account, you represent and warrant that you are at least 13 years old. If we discover you are under 13, we will immediately terminate your account and delete all associated data including biometric information.

Username Rules

• Your username must start with your actual first name
• You can add numbers or additional text after your first name
• This helps others identify who took their photos
• We may ask you to change your username if it doesn't follow this rule

Face Recognition Setup

To use HiFriends, you must:

• Complete our face recognition setup
• Allow us to create face encodings from your photos
• Consent to receiving photos of yourself

Note: Face recognition is required - it's how HiFriends works.

Accuracy: Face recognition is not 100% accurate. You may receive photos that aren't you (mark them "Not Me") or miss photos that are you. Accuracy improves over time.

Photo Delivery Consent

By using HiFriends, you consent to receiving photos of yourself taken by other HiFriends users. This may include users you don't know. You may delete any photo of yourself at any time using cascade delete.

Block Users (Coming Soon)

You will be able to block other users to prevent them from delivering photos to you or receiving photos you take of them.

4. Using HiFriends Responsibly

Do:

• Take photos with respect for others
• Follow all laws about photography in your area
• Report inappropriate content
• Be authentic

Don't:

• Post illegal content
• Harass, bully, or threaten others
• Share inappropriate or explicit content
• Impersonate others
• Use HiFriends for commercial purposes without permission
• Try to hack or disrupt the service

Photography Ethics

Important: HiFriends delivers photos automatically, but you're still responsible for:

• Getting consent where legally required
• Not photographing in prohibited areas
• Respecting people's privacy
• Following your school or workplace photography policies

5. Content Ownership

Your Photos

• You own the photos you take
• By using HiFriends, you give us permission to:
  • Store and process your photos
  • Deliver them to people in the photos
  • Use them to improve face recognition (anonymized)

Photos of You

• When someone photographs you, they own the photo
• You have the right to delete it from everywhere on HiFriends
• You can publish it to your profile if you want
• You can save photos you're in to your device

Screenshots

You acknowledge that HiFriends does not prevent screenshots or screen recordings. While you can delete photos from HiFriends, you cannot delete copies others may have saved outside the platform.

Photographer vs Subject Rights

• Photographers: Own the photos they take but must accept that subjects can delete them from HiFriends
• Subjects: Can always delete photos of themselves, no exceptions
• No notifications: Photographers aren't notified when photos are deleted

6. Deletion Rights

Cascade Delete

When you delete a photo of yourself:

• It's removed from ALL users on HiFriends within 48 hours
• This includes: your feed, photographer's camera roll, all other recipients' feeds
• Also removed from: your profile page and anyone else's profile page where it was published
• It's permanent and can't be undone
• The photographer is NOT notified
• The photographer may notice it's gone from their camera roll

Account Deletion

When you delete your account:

• All your data is deleted
• All your biometric data (face encodings) is permanently destroyed within 30 days
• Photos you took remain with recipients (without your name)
• Process completes within 30 days

7. Privacy & Data

• What data we collect

Key points:

• We never sell your data
• Face encodings are deleted when you delete photos or your account
• We comply with biometric data laws (including Illinois BIPA)

8. Content Moderation

We reserve the right to remove any content that violates these Terms, community guidelines, or applicable law, without notice. We may also report illegal content to law enforcement.

9. Beta Testing Program

HiFriends is currently in beta testing. By using the app, you acknowledge and agree:

What to Expect

• Things will break: Bugs, errors, and crashes are expected
• Things will change: Features may be added, removed, or modified
• Not always available: Service interruptions will happen
• Face recognition learning: Accuracy improves over time but isn't perfect
• Data might reset: Beta data might not transfer to the final version

Your Role

• Test the app and provide feedback
• Report issues to help us improve
• Be patient with problems
• Keep beta features confidential until public launch

No Guarantees

The beta version is provided "as is" without warranties. We don't guarantee it will work properly or consistently.

Feedback Rights

Any feedback, suggestions, or ideas you provide become our property to use without compensation.

10. Liability & Disclaimers

Service "As Is"

HiFriends is provided as-is during beta. We don't guarantee:

• 100% face recognition accuracy
• Uninterrupted service
• Bug-free experience

Limitation of Liability

To the maximum extent allowed by law, we're not liable for:

• Indirect or consequential damages
• Lost data or content
• User behavior or content
• Face recognition errors

Our maximum liability is $100 or what you paid us in the last 6 months (whichever is greater).

Indemnification

You agree to indemnify and hold harmless HiFriends Inc. from any claims arising from your use of the service, your content, or your violation of these Terms.

11. Changes to These Terms

We may update these Terms. We'll notify you of major changes through:

• In-app notifications
• Email
• Requiring you to accept new terms

Continued use after changes means you accept the new Terms.

12. Termination

You Can Leave Anytime

Delete your account through the app or email us.

We May Terminate If:

• You violate these Terms
• You engage in harmful behavior
• We discontinue the service
• We determine it's necessary for any reason (with notice when possible)

13. Disputes

Governing Law: Delaware law for corporate matters, California law for general disputes

Resolution Process:

1. Try to resolve informally by emailing us
2. If needed, disputes go to binding arbitration (not court)
3. No class actions - disputes are individual only

Opt-Out: You can opt out of arbitration by emailing us within 30 days of signing up.

14. General Terms

• These Terms are the entire agreement
• If part of these Terms is invalid, the rest remains
• We may assign these Terms; you may not
• No third parties benefit from these Terms
