HiFriends Terms of Service

1. Welcome to HiFriends

These Terms of Service (“Terms”) are between you and HiFriends Inc. By using HiFriends, you agree to these Terms and our Privacy Policy.

2. How HiFriends Works

Core Features

Automatic Delivery: When you take a photo, we use face recognition to automatically deliver it to the HiFriends users who appear in it. Because the people in a photo are not always people you know, this can include HiFriends users you don’t personally know — if someone in your photo is on HiFriends, they may receive it.
Scan & Deliver: If you turn it on, HiFriends can scan recent photos in your camera roll, on your device, to find ones with your friends in them, and deliver those photos to them. Scan & Deliver is optional and off unless you enable it.
Your Feed: Receive photos of yourself taken by others.
Cascade Delete: Delete any photo of yourself from everywhere on HiFriends — your feed, the photographer’s HiFriends Roll (the in-app collection of photos they’ve taken), and everyone else’s feed.
Your Profile: Choose photos to share on your HiFriends profile. Profiles are visible to other signed-in HiFriends users — by default, only to your friends. HiFriends profiles are not published on the open web.

Friends and Friend Search

Friend connections on HiFriends are one-sided: anyone can add you as a friend, and you can add anyone, without the other person needing to accept.
HiFriends includes friend search. Your first name, last name, and username are visible to other signed-in users through search, so people can find friends and identify who took their photos.

New Features

We’re constantly improving HiFriends. New features will be added regularly.

3. Your Account

Requirements

You must be 13 or older
Provide accurate information
Keep your password secure
One account per person — creating multiple accounts is not allowed, and we may remove duplicates we identify

By creating an account, you represent and warrant that you are at least 13 years old. If we discover you are under 13, we will promptly terminate your account and delete all associated data, including biometric information.

Username Rules

Your username must start with your actual first name
You can add numbers or additional text after your first name
This helps others identify who took their photos
We may ask you to change your username if it doesn’t follow this rule

Face Recognition Setup

To use HiFriends, you must:

Complete our face recognition setup
Allow us to create face encodings from your photos
Consent to receiving photos of yourself

Biometric Consent: By completing face recognition setup, you provide informed written consent to the collection, storage, and use of your biometric identifiers (face geometry) for the purpose of photo delivery and identification on HiFriends. This includes face data created during setup and face data that may be added over time, subject to quality limits, from photos other HiFriends users capture of you. All of this biometric data carries the same protections. You may withdraw this consent at any time by deleting your account.

Note: Face recognition is required — it’s how HiFriends works.

Accuracy: Face recognition is not 100% accurate. You may receive photos that aren’t you (mark them “Not Me”) or miss photos that are you. Accuracy improves over time.

By using HiFriends, you consent to receiving photos of yourself taken by other HiFriends users, and to photos you take being delivered to the HiFriends users who appear in them. In both cases, this may include users you don’t know. You may delete any photo of yourself at any time using cascade delete.

Camera Roll Access

Scan & Deliver requires access to your photo library. You control this through your device’s settings and can turn it off at any time. Our Privacy Policy explains what Scan & Deliver does with camera-roll photos.

Blocking

You can block any HiFriends user at any time. Blocking works in both directions: they can’t deliver photos to you and you can’t deliver photos to them, neither of you appears in the other’s search results or can view the other’s profile, and any existing friend connection between you is removed. The person you block is not notified.

4. Using HiFriends Responsibly

Do:

Take photos with respect for others
Follow all laws about photography in your area
Report inappropriate content
Be authentic

Don’t:

Post illegal content
Harass, bully, or threaten others
Share inappropriate or explicit content
Impersonate others
Use HiFriends for commercial purposes without permission
Try to hack or disrupt the service

Photography Ethics

Important: HiFriends delivers photos automatically, but you’re still responsible for:

Getting consent where legally required
Not photographing in prohibited areas
Respecting people’s privacy
Following your school or workplace photography policies

5. Content Ownership

Your Photos

You own the photos you take
By using HiFriends, you give us permission to:
- Store and process your photos
- Deliver them to the people in the photos
- Use them to improve the accuracy of photo delivery on your account

Photos of You

When someone photographs you, they own the photo
You have the right to delete it from everywhere on HiFriends
You can publish it to your profile if you want
You can save photos you’re in to your device

Screenshots

You acknowledge that HiFriends does not prevent screenshots or screen recordings. While you can delete photos from HiFriends, you cannot delete copies others may have saved outside the platform.

Photographer vs Subject Rights

Photographers: Own the photos they take but must accept that subjects can delete them from HiFriends
Subjects: Can always delete photos of themselves, no exceptions
No notifications: Photographers aren’t notified when photos are deleted

Feedback

If you send us feedback, suggestions, or ideas about HiFriends, you agree that we can use them — without restriction, compensation, or any obligation to you.

6. Deletion Rights

Cascade Delete

When you delete a photo of yourself:

It’s removed from ALL users on HiFriends immediately
This includes: your feed, the photographer’s HiFriends Roll, all other recipients’ feeds
Also removed from: your profile page and anyone else’s profile page where it was published
It’s permanent and can’t be undone
The photographer is NOT notified
The photographer may notice it’s gone from their HiFriends Roll
If the photo also lives on the photographer’s phone — for example, a photo they took with their own camera and sent through Scan & Deliver — that copy stays on their device. HiFriends removes the photo from HiFriends. We can’t remove it from someone’s phone.

Account Deletion

When you delete your account:

Your account, your photos, and your face data are all deleted
Your face data (face encodings) is permanently destroyed right away — not on a schedule
Photos you took of other people are removed from HiFriends, including copies that were delivered to other users
Everything is gone from HiFriends immediately. Clearing the underlying stored files runs straight after and completes within 30 days.

Key points:

We never sell your data
Face encodings are deleted when you delete photos or your account
We comply with biometric data laws, including Illinois BIPA and Colorado’s biometric requirements

8. Content Moderation

Zero tolerance. HiFriends has zero tolerance for objectionable content and for abusive behavior toward other people. Content that is illegal, sexually explicit, harassing, hateful, or threatening is not permitted, and neither is using HiFriends to harass, bully, threaten, impersonate, or intimidate anyone.

Reporting and blocking. You can report a specific photo from the photo itself, or report a user from their profile — for spam, harassment, impersonation, inappropriate content, or another reason. You can also block any user at any time, which immediately stops photos flowing between you in both directions and ends any friendship between you; unblocking does not restore it.

How we respond. We review every report and act within 24 hours. Where a report is upheld, we may remove the content, suspend the account, or terminate it permanently and bar the person from HiFriends.

Removing content. We may remove any content that violates these Terms, community guidelines, or applicable law, without notice. We may also report illegal content to law enforcement.

Your own control. Separately from anything we do: if you appear in a photo, you can delete it from HiFriends yourself, at any time, without asking us or the photographer.

9. Liability & Disclaimers

Service “As Is”

HiFriends is provided as-is. We don’t guarantee:

100% face recognition accuracy
Uninterrupted service
Bug-free experience

Limitation of Liability

To the maximum extent allowed by law, we’re not liable for:

Indirect or consequential damages
Lost data or content
User behavior or content
Face recognition errors

Our maximum liability is $100 or what you paid us in the last 6 months (whichever is greater).

Indemnification

You agree to indemnify and hold harmless HiFriends Inc. from any claims arising from your use of the service, your content, or your violation of these Terms.

10. Changes to These Terms

We may update these Terms. We’ll notify you of major changes through:

In-app notifications
Email
Requiring you to accept new terms

Continued use after changes means you accept the new Terms.

11. Termination

You Can Leave Anytime

Delete your account through the app or email us.

We May Terminate If:

You violate these Terms
You engage in harmful behavior
We discontinue the service
We determine it’s necessary for any reason (with notice when possible)

12. Disputes

Governing Law: These Terms, and any dispute between you and HiFriends, are governed by California law.

Resolution Process:

Try to resolve informally by emailing us — most issues can be sorted out this way
If needed, disputes go to binding arbitration (not court)
No class actions — disputes are individual only

Small claims: Instead of arbitration, either of us can bring an individual claim in small claims court.

Arbitration costs: If your claim is for less than $10,000, HiFriends will pay the arbitration filing, administration, and arbitrator fees, unless the arbitrator finds your claim frivolous.

What this doesn’t cover: The arbitrator can award you anything a court could award you individually. Nothing in this section takes away a right that the law says can’t be waived.

Opt-Out: You can opt out of arbitration by emailing us within 30 days of signing up.

13. General Terms

These Terms are the entire agreement
If part of these Terms is invalid, the rest remains
We may assign these Terms; you may not
No third parties benefit from these Terms
